TERMS OF SERVICE
1. General Provisions
These Terms set out the rules governing the provision of services by Aim English sp. z o.o., with its registered office in Warsaw, entered in the register of entrepreneurs of the National Court Register (KRS) under number 0001048304, NIP (Tax Identification Number) 5242978918, REGON (National Business Registry Number) 525889270 (hereinafter: “Aim English”).
Aim English provides exclusively organizational, administrative, communication and support services related to the Client’s participation in programmes organized by independent language schools (hereinafter: the “School”).
2. Nature of the Services
1. Aim English acts as a supporting and intermediary entity between the Client and the School.
2. Aim English provides exclusively organizational, administrative, communication and care-related support services related to the Client’s participation in programmes organized by independent third parties.
3. Aim English is not a tour operator or organizer of tourist events within the meaning of applicable law.
4. The services provided by Aim English are organizational, coordinating and care-related in nature.
5. Aim English does not provide educational services, accommodation, catering or transport — such services are provided exclusively by the School or other independent entities.
6. Aim English does not organize transport for participants.
3. Scope of Aim English’s Services
Aim English provides, in particular, the following services:
• selection of a suitable educational programme and school,
• support in the enrolment process,
• communication between the Client and the School,
• preparation of the participant for the trip,
• organizational support before and during the programme,
• organizational care of the participant during the trip (where applicable).
Such care is of a supportive nature and does not include tour-guide services or the organization of transport.
4. Services Provided by the School
1. The educational programme, accommodation, catering and additional activities are carried out exclusively by the School.
2. The Client enters into a separate legal relationship with the School.
3. The terms of participation in the programme are set out in the School’s rules and terms and conditions.
4. Aim English shall not be liable for the performance of services provided by the School.
5. The agreement concluded between the Client and Aim English does not constitute an agreement for participation in a tourist event, nor an agreement for the provision of educational services by Aim English.
6. Aim English shall not be liable for the decisions, actions or omissions of the School or other entities providing services to the Client.
5. Payments
1. Fees for the educational programme carried out by the School, including tuition, accommodation, catering and other services provided by the School, shall be paid by the Client directly to the School’s bank account, in accordance with the payment terms set by the School.
2. Aim English charges the Client a separate fee for the organizational, coordination and care-related services provided by Aim English.
3. The fee payable to Aim English is set out individually in the agreement concluded with the Client or in the offer presented to the Client.
4. Aim English is not a party to settlements between the Client and the School relating to services provided by the School.
5. Aim English may receive a commission or other remuneration from the School under separate cooperation agreements.
6. Reservation of a Place
1. A place in the programme is reserved upon: completion of the participant application form, and payment of the required fee in accordance with the terms set by the School or Aim English — depending on the type of service.
2. A deposit or reservation fee may be non-refundable in accordance with the terms set by the School or Aim English.
3. A place in the programme is guaranteed once the conditions set by the School have been met.
7. Visas and Documents
The Client is responsible for obtaining the required documents, including a visa.
Aim English may provide support in this regard but does not guarantee that a visa will be obtained.
In the event of a visa refusal, any refunds shall be made in accordance with the terms of the School and the individual terms applicable to the services provided by Aim English.
8. Cancellation and Refunds
1. Cancellation of participation must be made in writing.
2. Refunds of payments made to the School shall be handled exclusively by the School, in accordance with its rules and terms of participation.
3. Aim English is not obliged to refund amounts paid directly to the School.
4. Refunds of the fee payable to Aim English shall be made in accordance with the individual terms set out in the agreement concluded with the Client.
5. Aim English shall not be liable for banking costs, exchange rate differences, or fees charged by banks or payment operators.
9. Liability
1. Aim English shall be liable solely for services provided directly by Aim English.
2. To the extent permitted by applicable law, Aim English shall not be liable for:
• the School’s performance of the programme,
• the quality of services provided by the School or other third parties,
• accommodation and catering conditions,
• the organization of transport,
• administrative decisions made by the School,
• changes to the programme,
• refusal to issue a visa or other documents,
• acts or omissions of independent service providers.
3. Aim English does not guarantee the achievement of specific educational outcomes or the fulfilment of the Client’s individual expectations.
10. Force Majeure
Aim English shall not be liable for events beyond its control, in particular: pandemics, administrative decisions, visa restrictions, force majeure events, or changes made by the School to the organization of the programme.
11. Personal Data
The controller of personal data is Aim English.
Personal data is processed for the purpose of providing the services.
Personal data may be shared with the School and cooperating partners.
The Client has the right to access and rectify their personal data.
Detailed rules governing the processing of personal data are set out in the Privacy Policy available on the Aim English website.
12. Final Provisions
1. Polish law applies to services provided by Aim English.
2. In matters not regulated herein, the provisions of Polish law shall apply, in particular the Civil Code and consumer protection regulations.
13. Nature of Cooperation and Scope of Liability
1. Aim English supports the Client in organizing participation in educational programmes abroad but is not a party to the agreement concerning the educational services provided by the School.
2. The Client acknowledges that educational services, accommodation and other services are provided by independent third parties.
3. The scope of Aim English’s liability is limited exclusively to the organizational, coordination and care-related services provided directly by Aim English.
